Terms of Service

These Terms of Service (the "Terms") govern the use of the TestMW service (the "Service"), available at https://testmw.com and operated under the TestMW brand (the "Provider"). By registering for or using the Service, you (the "User") agree to these Terms.

1. General provisions

1.1. These Terms constitute a binding agreement between the Provider and the User.

1.2. By registering an account and/or using the Service, the User accepts these Terms in full.

1.3. The Terms take effect upon acceptance and remain in force until the parties have fulfilled their obligations.

2. Subject of the Terms

2.1. The Provider grants the User access to automated website testing tools in accordance with the selected plan, and the User agrees to use the Service in accordance with these Terms.

2.2. The list and cost of the plans are described on the pricing page.

3. Rights and obligations

The Provider undertakes to:

• Provide the User with access to the Service's functionality according to the selected plan;
• Maintain the availability of the Service, except during maintenance windows;
• Keep the User's data confidential in accordance with the Privacy Policy.

The User undertakes to:

• Provide accurate information during registration;
• Pay for paid plans in a timely manner;
• Use the Service only for lawful purposes and not infringe the rights of third parties;
• Not share access to their account with third parties.

4. Plans and payment

4.1. The cost of the Service is determined by the plan selected by the User.

4.2. Payment is made using the payment methods available in the User's account.

4.3. Funds added to the balance are a prepayment for the Service.

4.4. A service is considered rendered at the moment it is actually performed by the Service.

5. Refunds

5.1. Funds added to the balance are spent only inside the Service - they are exchanged for AI tokens or proxy traffic. Withdrawal or transfer of balance funds is not provided.

5.2. Funds charged for services already rendered are non-refundable. Because the Service is delivered as a digital, intangible service, amounts spent on test runs, AI tokens and other functionality actually consumed are not refunded.

5.3. A refund is possible only where the service was not delivered due to a technical fault of the Service, or where access to the paid functionality was in fact never provided.

5.4. To have a refund considered in the cases described in clause 5.3, the User must contact support at support@testmw.site within 24 hours of the payment.

5.5. Each refund request is reviewed by the Provider individually; an approved refund is processed within a reasonable period after the request is confirmed.

5.6. The User agrees not to initiate a payment reversal (chargeback) through a payment system or card issuer without first contacting the Provider's support.

6. Disclaimer of warranties and limitation of liability

6.1. The Service is provided on an "AS IS" basis.

6.2. The Provider does not warrant that the Service will meet the User's expectations, that it will lead to any particular commercial, financial or professional result, or that it will operate without interruption or errors.

6.3. The Provider is not liable for interruptions in the Service caused by force majeure, the actions of third parties or maintenance.

6.4. The Provider is not liable for testing results, for any direct or indirect losses (including lost profit), or for decisions the User makes based on those results. All decisions on how to apply the Service's output are taken by the User independently and at the User's own risk.

6.5. The Provider's total liability is limited to the amount paid by the User for the current usage period.

7. Lawful use

7.1. The Service is intended for testing websites and applications that the User owns or is otherwise authorized to test.

7.2. The User undertakes to use the Service solely within applicable law and within the terms of the third-party resources involved, and not to use it to bypass protections, to place excessive load on third-party resources or for any other unlawful activity.

7.3. Responsibility for the lawfulness of how the Service is used rests entirely with the User.

8. Intellectual property

8.1. All materials of the Service - software, interfaces, documentation, texts and graphics - are protected by intellectual property law.

8.2. The User may not copy, distribute, resell, transfer to third parties, decompile or otherwise use the Service's materials without the rightholder's permission.

8.3. Test scenarios, logs, screenshots and reports created by the User in the Service remain the User's data.

8.4. Infringement of intellectual property rights may result in access to the Service being restricted without compensation.

9. Restriction of access

9.1. The Provider may suspend or restrict the User's access to the Service in the event of: a breach of these Terms; detected abuse of the Service; or requirements of applicable law or of payment providers.

9.2. Restriction of access does not release the User from obligations that arose earlier.

9.3. The Provider reserves the right to refuse service to Users whose actions may create elevated risk for the Service, its payment providers or third parties.

10. Personal data

10.1. The User's personal data is processed in accordance with the Privacy Policy.

10.2. The Provider takes reasonable measures to protect data but does not guarantee the absolute security of information transmitted over the internet.

11. Disputes

11.1. The parties will seek to resolve any disputes through negotiation.

11.2. Any dispute that cannot be resolved through negotiation will be settled in good faith by the parties.

12. Term and termination

12.1. These Terms remain in force indefinitely from the moment of acceptance.

12.2. The User may stop using the Service at any time.

12.3. The Provider may suspend or terminate access if the User violates these Terms.

13. Changes to the Terms

13.1. The Provider may amend these Terms. The current version is always published on this page.

13.2. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
